Graphic Leftover's Seller Agreement

Thanks for choosing to Graphic Leftovers to sell your images. Before we get started there are a few things you need to know in order to start selling. We've made it very organized and easy to understand. Please read and agree to the terms below and then you can start uploading files!

About Graphic Leftovers
Graphic Leftovers is a venue to sell your images. We provide a safe and secure marketplace for users to purchase and download quality images provided by our sellers. Graphic Leftovers is owned and operated by Digital Leftovers, LLC.

Become a Seller
The first thing you need to do is become a member of Graphic Leftovers. Once you are registered, go to your account page and select "Become a Seller" in the sidebar.

Seller Earnings
Sellers earn 52% of their chosen sale price for every download. For example, if you sell an image for $5, you will earn $2.60 each time that image is purchased. You also earn 52% of each merchandising license and ultimate license purchased.

Payment
Each time your image is purchased, the sale will appear in your transaction history section of your account page. Once your earnings balance reaches $50 you may request a payout. Payouts are made by PayPal, MoneyBookers or by check. You will be able to select your payment method. Payments are made within 48 hours of payment request.

Uploading Images
Uploading to Graphic Leftovers is a very simple process. We offer fast multiple image uploading and FTP uploading for sellers with large portfolios. Graphic Leftovers supports IPTC metadata and accept iSyndica submissions.

Quality Requirements
To keep Graphic Leftovers filled with quality images we will be considering the following criteria:

  • File preparation
  • Production Quality
  • Content
  • Customization

If for some reason your submission does not meet one or more of these requirements, then your submission may not get approved. Some of these reasons might be:

  • If it is similar to other images already on the site
  • If the files are corrupt or carry a virus
  • If the item is difficult to use or implement

Legal Requirements
As a seller you are responsible for only selling images that belong to you. By becoming a seller, you are making an agreement not only with Graphic Leftovers but also with anyone who purchases and downloads your work that you own full copyright and have appropriately licensed any auxiliary content. It is essential that you understand Graphic Leftovers Legal Requirements before you begin uploading files. We take copyright violation very seriously. If we discover that any of your images have violated copyright, we will remove ALL your portfolio from Graphic Leftovers, seize all earnings and commissions, and in some cases take legal action.

Copyright
You can find a full definition of copyright on the U.S. Copyright office website and how it relates to international copyright relations. Here is a short description: Copyright is a legal concept that gives the creator of an original work exclusive rights to it. The copyright holder has the right to choose if anyone else can use, adapt or resell their work and have the right to be credited for that work. Only the copyright holder of a work may do the following:

  • Make copies of the work and distribute them
  • Create derivative works or alter the work in any way
  • Sell the work in either it's original version or in an altered form
  • The creator of a work retains copyright to it even if they don't expressly tell you so

Copyright Infringement
A copyright infringement or violation is the unauthorized use of work that is covered by copyright. If you use, alter or sell someone else's work, you are violating their copyright and essentially breaking the law. Here are some requirements to comply with copyright violations:

  • Your art must NOT include any brand names, logos or trademarks. For example: You cannot use an Apple or McDonalds logo, even if you have recreated it, photographed it, or altered it. You cannot use a photo of a watch if the brand name of the watch is legible.
  • Your art must NOT be based on any other file. For example: You cannot submit an image that is similar to an image on an established website.
  • You must NOT upload files that have been decompiled from another file. For example: You cannot decompile a file and resell it, even if you alter it significantly.
  • You must NOT upload a file that uses free or purchased components from any other source without an express license to do so. For example: You cannot download a file then use part or all of it in a file for sale.
  • You must NOT upload a file that uses government or military property. For example: You cannot submit a file that contains a presidential seal or military insignia.
  • You must NOT upload images that you purchased or downloaded and then resell it. For example: You cannot submit a file that you have purchased or downloaded from another stock site.

Licenses
Graphic Leftovers offers three types of licenses:

The Standard License grants buyers a non-exclusive, non-transferable license to make use of and display the image in a website or print project. A maximum of 10,000 copies incorporating the image may be made.

Buyers CAN use the image for:
  • Brochures
  • Advertisements
  • Billboards and Banners
  • Folders
  • Catalogs
  • Presentations
  • Website or Blog Development
  • Flash Animations
  • Promotional Posters
  • Letterhead and Business Cards
  • Signage
  • Flyers or Direct Mail
  • Opt-in Email Marketing
  • Packaging and Labels
  • CD/DVD covers
Buyers CANNOT use the image:
  • for redistribution, resell, lease, license, sub-license or offer free downloads of the image in its present form or in a modified form to any third party.
  • in the development of web applications, web templates or software programs. Providing this artwork to customers will be considered redistribution and is not permitted.
  • as part of a trade-mark, design-mark, trade-name, business name, service mark, or logo.
  • on shared drives, intranets, computer networks or the like.
  • to display in such a way as to suggest that the product was created by the them.

Purchase of a Merchandise License grants buyers a non-exclusive, non-transferable license to make use of and display the image in merchandise for resale or distribution, clothing, greeting cards, magnets, calendars, web templates, games and wallpapers. A maximum of 10,000 copies incorporating the image may be made. For example, you can use the image on t-shirts, mugs, hats or any other products for sale, not including Print on Demand sites such as Zazzle or Cafe Press. You may not resell the Image that you acquire unless it is incorporated into a work you have created.

Buyers CAN use the image for:
  • T-shirts/Clothing
  • Mousepads
  • Mugs and Cups
  • Totes and Bags
  • Posters
  • eBooks
  • Canvas or Giclee Prints
  • Film or Video for Distribution
  • Greeting Cards
  • Textbooks
  • Web Templates
  • Software
  • Wallpapers
  • Calendars
  • Other Resale Items
Buyers CANNOT use the image:
  • to re-license, sub-license or distribute the image. Buyers cannot purchase the image once from Graphic Leftovers and sell it or license it to one or more clients or advertise it for sale.
  • as part of a trade-mark, design-mark, trade-name, business name, service mark, or logo.
  • on shared drives, intranets, computer networks or the like.
  • to display in such a way as to suggest that the product was created by the them.
  • unless it is incorporated into a work the buyer has created.

Purchase of an Ultimate License grants you both the Standard and Merchandise Licenses outlined above and allows an unlimited number of copies incorporating the image may be made.

Annual Review of Files
Each year, Graphic Leftovers reviews the entire image library. If your files do not pass review, you will receive email notification and your file(s) will become inactive after 30 days.
